Terms of Use

These Terms of Use ("Terms") govern your access to and use of the MacroCam mobile application ("App") and the website at https://macrocam.app ("Website"), operated by MacroCam Inc. ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal iOS device for your personal, non-commercial use, subject to these Terms.

You may not:

Copy, modify, distribute, sell, or lease any part of the App
Reverse engineer, decompile, or disassemble the App
Remove any copyright, trademark, or proprietary notices
Use the App for any illegal, harmful, or unauthorized purpose
Attempt to gain unauthorized access to our systems or servers
Use automated systems (bots, scrapers) to access the App

3. Subscriptions and Payments

3.1 Subscription Plans

MacroCam offers premium features through subscription plans (weekly, monthly, yearly) and a lifetime purchase option. Prices are displayed in the App and may vary by region.

3.2 Billing

All payments are processed by Apple through the App Store.
Payment is charged to your Apple ID account upon confirmation of purchase.
We do not have access to your payment information.

3.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
The renewal price will be the same as the original subscription price, unless we notify you of a price change.

3.4 Free Trials

If a free trial is offered, it begins when you start the trial and ends when the subscription billing period begins. If you cancel during the trial period, you will not be charged. Any unused portion of a free trial is forfeited when you purchase a subscription.

3.5 Cancellation

You can cancel your subscription at any time through your Apple ID settings: Settings > [Your Name] > Subscriptions > MacroCam. Upon cancellation, you retain access to premium features until the end of your current billing period.

3.6 Refunds

Refunds are handled by Apple in accordance with Apple's refund policy. To request a refund, visit reportaproblem.apple.com. We cannot process refunds directly.

4. User Content

Any content you create within the App (data, settings, preferences) remains your property. We do not claim ownership over your content. Content created within the App is stored locally on your device unless otherwise specified.

5. Intellectual Property

The App, including its design, code, graphics, logos, icons, and content, is owned by MacroCam Inc. and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

"MacroCam" and the MacroCam logo are trademarks of MacroCam Inc.. You may not use our trademarks without prior written permission.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will be uninterrupted, timely, secure, or error-free
Results obtained from the App will be accurate or reliable
Any errors in the App will be corrected
The App will be compatible with all devices or operating system versions

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MACROCAM INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless MacroCam Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

10. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App is immediately revoked.

You may terminate your use at any time by uninstalling the App and cancelling any active subscription.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which MacroCam Inc. is registered, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MacroCam Inc. regarding your use of the App and supersede all prior agreements.
